Movers and Shapers Take-It-OFF Club – Terms and Conditions of Membership
These Terms and Conditions (“Terms”) govern your participation in the Movers and Shapers Take-It-OFF Club (the “Club”), an annual membership product exclusively available to graduates of our official weight loss course. By purchasing and activating your membership, you acknowledge that you have read, understood, and agreed to these Terms in full.

1. Membership Eligibility
- Membership is strictly available only to graduates of the official course offered by our organisation.
- By enrolling, you confirm that you have completed the prerequisite course and understand the content therein.
- If a person signs up and pays for the membership without meeting the eligibility criteria, we will cancel their membership and issue a refund less a R75 (ZAR) administration fee to cover processing and administrative time.

2. Membership Fee and Payment
- The Club membership is charged as an annual fee, payable in full and in advance.
- No installment plans or deferred payments are available unless explicitly offered in writing.
- Access to the Club benefits (including Facebook group membership and materials) will only be granted after the 7-day cooling-off period has passed, to protect the integrity and confidentiality of our proprietary materials. Early access is not permitted under any circumstances.

3. Cooling-Off Period (CPA Compliance)
- In compliance with the Consumer Protection Act of South Africa, you are entitled to a 7-day cooling-off period from the date of purchase.
- If you cancel in writing within this 7-day period, you will receive a full refund.
- After the 7-day cooling-off period, no refunds will be issued under any circumstances, as you receive full and immediate access to all Club resources and materials thereafter.

4. Non-Usage and Early Exit
- It is the member’s responsibility to make full use of the Club benefits during the 12-month membership period.
- No refunds or partial credits will be issued for unused benefits or if the member chooses to exit the Club early, for any reason.
- The annual membership fee covers a fixed 12-month period only, starting from the date access is granted.
Once this period ends, it will not be extended or carried over — even if the member did not use some or all of the benefits.
- No free or grace period extensions will be granted. To continue access beyond the paid term, a new annual fee must be paid.

Suggest and vote on upcoming content and features.
✅ Free Email Support via Our Help Desk Ticket System
Submit individual course-related questions through our official support system.
✅ Group Question & Answer Support
Ask and receive support from facilitators and peers within the group forum.
All these benefits are delivered via the official private Facebook group named "Movers and Shapers Take-It-OFF Club" and Free Email Support is delivered via our official helpdesk ticket system.

6. Cancellation by CLIFF Lifestyle
- We reserve the right to terminate a membership at our discretion for any reason, including but not limited to violation of these Terms, inappropriate conduct, or breach of community guidelines.
- In such cases, we may offer a partial refund based on a fair use assessment, at our sole discretion. Our decision in such matters is final and binding.
- If CLIFF Lifestyle is unable to deliver the Club benefits due to our own negligence, a pro-rata refund will be issued.

7. Force Majeure
- CLIFF Lifestyle shall not be held liable or responsible for any failure or delay in performance due to events beyond our control, including but not limited to: natural disasters, internet outages, third-party platform issues (e.g., Facebook), or governmental restrictions. No refunds will be issued in these cases.

8. Community Conduct and Security
By joining the Club, you agree:
- Not to copy, redistribute, resell, or repurpose any content, downloads, community discussions, or materials made available through the Club.
- Not to solicit, poach, recruit, or advertise any other products, services, or communities within the Club.
- Not to harass, troll, or abuse fellow members or Club staff, either within or outside the community group.
- Breach of these terms will result in immediate removal without refund, and may lead to legal action if warranted.

9. Health and Medical Disclaimer
- The Club and its content are provided by coaches, not medical professionals.
- You are strongly advised to consult with a medical doctor before beginning or continuing any weight-loss or lifestyle change program.
- You agree and understand that:
- No promises, guarantees, or warranties of any kind (including weight loss or health outcomes) are made.
- You are responsible for your own health, wellbeing, and lifestyle choices.
- CLIFF Lifestyle and their staff are not liable for any personal health decisions or outcomes, whether positive or negative.

10. Children and Minors
- Membership is strictly limited to individuals aged 18 years and older.
- Children and minors are not permitted to join or participate in any part of the Club.

11. Communication and Support
- All official support and communication must go through our designated support ticket system, available on our website.
- We do not respond to support requests made via social media, personal messaging, email, or phone.

12. Jurisdiction and Legal Disputes
- These Terms shall be governed by the laws of the Republic of South Africa.
- Any legal disputes must be filed and pursued in the court jurisdiction nearest to our primary business address in KwaZulu-Natal, South Africa, regardless of the member’s location.
- All legal expenses, filing fees, travel costs, and legal representation costs incurred by the member in pursuing any dispute are the sole responsibility of the member.

13. Agreement and Binding Effect
- By purchasing your membership, you acknowledge and agree to be bound by these Terms and Conditions.
- These Terms constitute the entire agreement between you and CLIFF Lifestyle with respect to the Club.
- These Terms supersede any previous verbal, written, or implied agreements.
